Clemons pleads not guilty in intitial hearing

FAIRLAND, INDIANA---The Shelby County man state officials believe was supplying animals to cockfighting operations had an initial court hearing Friday.

Edward “Wally” Clemons, 60, Fairland, was arrested Thursday afternoon and taken to the Shelby County jail on charges the Shelby County Prose-cutor’s Office filed in early August.

 Clemons pleaded not guilty Friday afternoon at an initial hearing in Shelby Circuit Court. He’s facing charges of possession of animal for purpose of animal-fighting contest and promoting an animal-fighting contest, both Class D felonies; and possession of animal-fighting paraphernalia, a Class B misdemeanor.

According to the court’s log, Clemons’ bond was set at $15,000 and his next court appearance is at 9 a.m. Sept. 23.

A correctional officer present at Clemons’ hearing said Clemons requested a court-appointed attorney, but Senior Judge Barbara Harcourt questioned whether Clemons could afford one on his own. The court instructed him to try to find his own attorney.

The Indiana Gaming Commission investigated Clemons with the help of the Humane Society of the United States for about a month before they seized 193 chickens from his home at 5640 Frontage Road, outside of Fairland, on Aug. 5. The Humane Society on July 6 notified the state of an article in a Filipino magazine in which Clemons implied that he was involved in cockfighting, according to court documents.

In addition to the chickens, court documents said officials found a variety of paraphernalia related to cockfighting, including specific knives, shears to remove the roosters’ combs, a record book and magazines.

The maximum sentence Clemons could face if he’s found guilty on the charges is six years in prison.

Indiana State Police arrest an Avilla man on child molesting charge

AVILLA, INDIANA---The Indiana State Police arrested a 53 year old Avilla man Friday on a preliminary charge of child molesting.

 Police think Frederick W. Weese molested a family member.

According to police, the victim and her family contacted the Noble County Division of Family and Children. 

They said that Weese committed inappropriate sexual conduct at a house in Ligonier back in 2002, when the victim was then 8 years old.

On Friday, August 27, the Division of Family and Children contacted the Indiana State Police. 

They investigated and made the arrest one week later.

Weese was taken to and incarcerated in the Noble County Jail pending an initial hearing.

Indiana state police and Feds seize $47.5 million in pot

BEDFORD, INDIANA---Indiana State Police and federal agents working by air and land say they have removed 19,000 marijuana plants with an estimated street value of $47.5 million during an effort called Operation Hoosier Thunder.

Teams from the state police, the Indiana National Guard, the U.S. Druge Enforcement Agency and other agencies descended on southern Indiana on Aug. 23 after investigations showed illegal drug trafficking operations near the Hoosier National Forest and on other state and federally owned property.

Investigators say they found 7,513 plants Tuesday in the Hoosier National Forest. No arrests have been made in that case, but state police say 316 illegal marijuana plots were discovered and 20 suspects have charges pending in the operation statewide.

4 cops hurt in crash

WASHINGTON D.C.---Four off-duty D.C. police officers — three on their way home from work and one on the way in — were injured when their vehicles collided in the Oxon Hill-Fort Washington area Thursday night, according to police and law enforcement sources.

The crash occurred just after 10:30 p.m. on Indian Head Highway and Old Fort Road, authorities said. According to a law enforcement source, a vehicle carrying three D.C. police officers on their way home from work appeared to run a red light as it made a left turn onto Old Fort Road, and it was T-boned by a vehicle carrying another D.C. police officer on the way to work.

All four officers were injured, though none critically, authorities said. Wendell Cunningham, vice chairman of the D.C. police union, said the officer heading into work has been released from the hospital. He said two others remain at MedStar in stable condition, and he was unsure of how the fourth officer was doing.

Police and law enforcement sources said alcohol and drugs do not appear to be factors in the crash. One law enforcement source said the crash appears to be a simple traffic error, and the fact that all involved were D.C. police officers was a coincidence.

None of the vehicles involved was a D.C. police cruiser, authorities said. The officers in the vehicle that ran the light were in uniform, and the officer in the other vehicle was in plain clothes.

 TWO FACE MULTIPLE FELONY CHARGES

IN FRAUDULENT PRESCRIPTION INVESTIGATION

KOKOMO, INDIANA---A Kokomo pharmacist and a Kokomo optometrist face multiple felony drug charges following a lengthy investigation by the Howard County Sheriff Department into the fraudulent dispensing of prescription drugs.  Mark C. Allion, 62, of 900 block of  Parkway Ct, Kokomo surrendered himself at the Howard County Jail late Thursday afternoon.  Allion, a former K-Mart pharmacist, faces five (5) class A felony counts of dealing in a schedule II controlled substance, and nine (9) class B felony counts of dealing in a schedule II controlled substance. 

<<<Dr. James Phillip Montgomery, 64, of the 2500 block of West Carter St, Kokomo faces four (4) class A felony counts of aiding, inducing, or causing dealing in a schedule II controlled substance, one (1) class A felony count of conspiracy to commit dealing in a narcotic drug, and ten (10) class B felony counts of aiding, inducing, or causing dealing in a schedule II controlled substance.  Howard Superior Court 1 bench warrants were issued for Allion and Montgomery on Thursday afternoon.  Each man’s bond was set at $75,000.  Allion posted bond Thursday evening, and was released from custody.    Montgomery arrived at the Howard County Jail at 2:30 p.m. Friday, accompanied by his attorney Brad Hamilton.  Montgomery posted bond, and was released from custody.

Howard County Sheriff Deputy Matt Roberson began the investigation in May of last year after a pharmacy inspector with the Indiana Professional Licensing Agency contacted the Sheriff’s Department informing them of possible narcotics violations at the K-Mart Pharmacy located at 205 N. Dixon Road in Kokomo .  Inspector Tim Thomas suspected that Montgomery was writing fraudulent prescriptions, and Allion was filling them.  Montgomery was not authorized to write the prescriptions, and D.E.A. numbers appearing on the fraudulent prescriptions belonged to other physicians.  The prescriptions were written and filled under several names, with Montgomery picking up and paying for the drugs. 

When other physicians were questioned during the investigation they denied knowledge of the activity, or having any contact with any of the patient names on the prescriptions.  “During the course of the investigation Deputy Roberson placed himself inside the K-Mart store and witnessed a transaction between the pharmacist and the optometrist,” said Sheriff Marty Talbert.   Investigators also learned that Montgomery was obtaining Oxycontin under a legitimate prescription, and distributing the drug in Grant County .  “We received assistance from Grant County Sheriff Department undercover investigators, who were able to purchase some of the Oxycontin that was distributed by Montgomery ,” said Sheriff Marty Talbert.

The K-Mart pharmacy on north Dixon Road is located less than 1,000 feet from Wallace School , which allowed several of the counts to be filed as a class A felony offenses during the times school was in session. 

Allion no longer works for K-Mart.  “K-Mart was cooperative during this investigation,” said Detective Matt Roberson.  “They terminated Allion when they became aware of the investigation,” Roberson added.  Montgomery ’s optometrist license is currently under indefinite suspension.  According to the Indiana Professional Licensing Board website Allion is still licensed as a pharmacist.  “We are notifying the Indiana Professional Licensing Board of these arrests so they may take whatever action they deem necessary,” said Sheriff Marty Talbert. 

The Howard County Sheriff Department was assisted in the investigation by the Drug Enforcement Administration, the Indiana State Police, the Indiana Attorney Generals Office, Grant County Sheriff Department, and the Indiana Professional Licensing Agency.

Man arrested on meth charges dies in Warrick County Jail

BOONVILLE, INDIANA---One of five people arrested after a meth bust has died in the Warrick County Jail.

The sheriff's office says 34-year-old Leonard Broshears Jr., of Chandler was found unresponsive in his cell about 1 a.m. Friday.

<<<Leonard Broshears Jr and four others had been arrested at a home there about 4 a.m. Thursday.

Attempts to revive Broshears were made by jail staff, Warrick EMS and the Boonville Fire Department.

The cause of death is under investigation by Indiana State Police and the Warrick County Coroner. An autopsy is pending.

Deputies say they were responding to a loud music complaint on Lee Acres Drive east of Chandler Thursday morning when they say they found an active meth lab in an outbuilding.

Deputies say three children at the home were turned over to child protective services.

The four others facing drug related charges are Terry Kellems, Michael Negovan, Tikemia Johnson and Melissa Broshears.

Former Toll Road trooper admits to spanking speeder

ANGOLA, INDIANA---A former Indiana State Police officer admitted he “spanked” a woman he pulled over for speeding on the Indiana Toll Road.

Michael D. Mosier, 28, resigned from the force Tuesday and charges of official misconduct and battery were filed by Steuben County Prosecutor Thomas Wilson on Wednesday. An initial hearing is set for Nov. 15 at 1:30 p.m. in Steuben Magistrate Court. Mosier will be issued a summons by certified mail.

He is accused of acting inappropriately with a female driver he pulled over on July 23 at the 137 mile marker, near Orland. Mosier directed her to join in him in his patrol car.

In an interview with an Indiana State Police detective, Mosier admitted to telling the woman he didn’t give out warnings. “It’s tickets or spankings,” he told her, according to court documents. Mosier allegedly wrote out the warning nonetheless then slapped her on the bottom as she was leaning away from him in the car. He allegedly followed that up by asking her not to say anything to anyone. When she said she planned to tell, he allegedly tried to take the warning ticket from her hand.

In Mosier’s version, the woman said she would accept the spanking instead of the ticket. She contends she did not give him consent to touch her.

And next time, he allegedly told her, he would ask for a “boob show.” She told him there wouldn’t be a next time, court documents say, and Mosier grabbed her left breast.

Mosier allegedly admitted to touching the woman’s breast as she sat in the car.

Touching someone in a rude or insolent manner constitutes battery, a Class B misdemeanor. Mosier is charged with two counts of battery, as well as a Class D felony count of official misconduct. That charge carries up to a three-year prison sentence.

FBI looking into scuffle between metro police officer, state trooper

INDIANAPOLIS, INDIANA---Indianapolis Public Safety Director Dr. Frank Straub has asked the FBI to investigate IMPD Deputy Chief William Benjamin.

Chief Benjamin and an Indiana State Police trooper got into an argument in Benjamin's office two weeks ago and authorities want to find out if Benjamin somehow violated the trooper's rights.

Dr. Straub has referred all questions about the case to the FBI. Fox59 News has also learned Benjamin, as well as those demoted over the Officer Bisard investigation will seek legal representation from the Fraternal Order of Police.

Indiana state trooper charged with felony, resigns over groping case

ANGOLA, INDIANA---An Indiana State Police trooper has resigned amid allegations he groped a woman during a traffic stop.

Michael D. Mosier, 28, was charged Wednesday with a felony count of official misconduct and two misdemeanor counts of battery. He has not been arrested but instead was given a summons to appear in court on the charges.

Mosier is accused of groping a 19-year-old woman he pulled over during a traffic stop this summer, Steuben County Prosecutor Tom Wilson said.

Mosier pulled the woman over for speeding on the Toll Road in Steuben County, Wilson said, and told her to get into his police cruiser. While she was in his police car, Mosier touched the woman inappropriately, Wilson said. Afterward, the woman reported Mosier’s behavior to authorities.

“It occurred while he was on active duty as a state trooper,” Wilson said. “To my knowledge, he didn’t know her.”

The allegations were investigated by a detective at the Indiana State Police post, he said.

“She didn’t do anything that would have caused him to touch her,” Wilson said. “He touched her on the posterior and on the chest.”

Mosier, with the state police for 2 1/2 years, was assigned to the Indiana Toll Road post based in Elkhart County.

He resigned Tuesday.

Just last month, Lt. Dallard Tackett, 58, commander of Mosier’s former post and a 31-year veteran of the state police, resigned.

Investigators believe Tackett cashed checks from his post for personal use instead of sending them to Indiana State Police headquarters in Indianapolis.

Tackett resigned Aug. 20, the same day he was questioned about the checks, a state police official said.

The Toll Road post oversees the seven counties along the northern border of the state, including LaGrange and Steuben.

Crashed cyclist may have been going 100 MPH

EVANSVILLE, INDIANA---Police say a motorcycle rider was seriously hurt after crashing Tuesday night.

It happened around 10:30 on I-164 near the Green River Road exit.

Evansville Police say a trooper from Indiana State Police clocked a motorcycle traveling 100 miles per hour.  The trooper turned on his emergency lights while parked in the median in an effort to get the rider to slow down, but decided he couldn't safely pursue the cycle.

Moments later, another driver called to report motorcycle parts in the roadway.  EPD officers responded and found the crash site, just west of the 1.8 mile marker on the north side of I-164.

Police say 30-year-old Jason Wayne Carver's motorcycle appeared to have become airborne after leaving the roadway. 

Officers at the scene say he suffered head trauma and was rushed to St. Mary's.  14 News spoke with a family member Wednesday morning who indicated Carver had suffered bleeding on the brain, a fractured neck and spine and a collapsed lung.
